Can a dispute be mediated after a lawsuit is filed?
If a couple has decided upon divorce but has the foresight to understand that it is in their best interest as well as the best interest of the children, if they have any, to agree upon all issues or at least attempt to reach agreement on all the issues, they can choose to voluntarily go to mediation. The same is true for any family conflict, it can be mediated before any party hires an attorney. If family members mediate before hiring an attorney or filing a lawsuit, the agreement can be formalized and filed with the court by both parties.
Or, if one or either party has consulted or retained an attorney, but the parties would still like to attempt to resolve all relevant issues without an emotional court battle, the party can ask their attorney to arrange for mediation.« Blog Home
