Fees & Scheduling
An hourly rate of $150.00 per hour will be charged for Domestic Relations mediation. For families with a combined household income of less that $39,113.oo the hourly mediation rate is $100.00. This will apply to time spent time at the mediation session(s) and time spent following mediation. Time following mediation may include the preparation of documents for the parties’ signatures, drafting agreements for review by counsel, and preparing motions, reports, or correspondence to the Court.
A one-time, non-refundable Administrative Fee of $100.00 will be charged for the time spent setting up the mediation file, distributing initial documents, scheduling mediation sessions, and for reviewing intake documents and questionnaires prior to the actual mediation. This charge is not refundable, even if a mediation session is not held.
Mediations are scheduled at minimum two-hour sessions. Typically mediation sessions will be scheduled for 4 hour or 8 hour sessions with the goal of completing all issues during the mediation. However, parties have the option of dividing the mediation into 2 hour sessions and not trying to address all issues at one time.
Scheduling a Mediation:
To schedule a mediation, call Southern Indiana Mediation at 812-463-2727. A brief phone call will obtain the names of the parties, contact information and a summary of the issues. SI Mediation will then submit (preferably by email) a short questionnaire and agreement for the parties to complete sign and return. Each party is to submit one-half of the one-time Administrative Fee with their documents. Once the documents are received, SI Mediation will contact the parties to schedule the mediation. If the parties are represented by attorneys, all documents, scheduling and fees will be handled through the attorneys. If the parties are not represented by attorneys, the Minimum Session Charge (2 hours of mediation) must be received at SI Mediation 5 business days before the scheduled mediation—each party paying one-half. Payment can be made by debit or credit card. If payment has not been received at least 5 business days prior to the scheduled mediation, except in unusual circumstances, the scheduled mediation will, at the option of the Mediator, be postponed or rescheduled until payment has been received. If the mediation goes beyond the 2 hour Minimum Session Fee paid in advance, payment is due at the end of each mediation session. Unless other arrangements have been agreed upon between the parties, it is assumed that each party will be paying half of the fees.
Cancellation or Rescheduling of a Mediation Session:
If a mediation session is cancelled or rescheduled less than 3 business days before a scheduled mediation, the Minimum Session Charge will be forfeited, unless another mediation session can be scheduled within the following 3 months. If your appointment is rescheduled more than 3 business days before your scheduled appointment, the parties can either have the Minimum Session Charge refunded less the $100 administration fee or reschedule the mediation at a later date.
In the event that an emergency such as sickness or weather problems beyond the control of the parties causes a mediation to be cancelled or rescheduled less than 3 days before the scheduled mediation, the Minimum Session Charge will not be forfeited, although if the mediation is not rescheduled for a date within 30 days of such occurrence, then, absent exceptional circumstances, the Minimum Session Charge will be forfeited. If a party fails to appear at a scheduled mediation and such absence is not caused by sickness, weather problems, or other circumstances beyond that person’s control, then that party will be responsible for paying the fee for that session without contribution by the other party.
